MELVILLE, NY (December 7, 2017) – Bruno, Gerbino & Soriano (BG&S) LLP, led by founding partner Vince Gerbino, garnered a big win in November for Global Liberty Insurance Company of New York following a successful Appellate argument involving a complex coverage issue regarding a “black car” automobile policy.
“We’re pleased with the end result and are satisfied that justice was served,” said Gerbino. “Removing any ambiguities, we were able to prove that our client’s policy did not extend coverage beyond the negligence of the insured vehicle and the insured.
The insurance coverage dispute versus Peter and Kathy Fontana involved BG&S’s client Global Liberty Insurance Company of New York whereby they asserted that the coverage under Global’s policy extended only to insured Royal Dispatch Services, Inc. for which Cheung was a franchisee and not Cheung.

The case stemmed from a single-vehicle accident that Cheung incurred in 2010 while driving plaintiff Peter Fontana, an employee of one of Royal’s customers, from New York City to a location in New Jersey. During the trip, Fontana suffered significant injuries.

Following argument, the Appellate Court concluded that the previous Court order be reversed in part finding that the policy in question did not cover the franchisee Cheung.
